Terms of Service

By registering for, accessing, or using the Mech Connect platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree to these Terms, do not register for or use the Service.

Mech Connect provides a cloud-based garage management platform that allows automotive workshops to manage job cards, customer records, vehicle history, invoicing, inventory, accounting, team productivity, and customer communications.

The features available to you depend on the subscription plan you have selected. We reserve the right to modify, add, or remove features from the platform at any time with reasonable notice.

To use the Service, you must register for an account. You agree to:

• Provide accurate, complete, and current registration information
• Maintain the security of your password and not share it with others
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account
• Not create accounts for the purpose of abusing the Service or violating these Terms

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

Mech Connect operates on a subscription basis. By subscribing to a paid plan, you agree to:

• Pay the subscription fees applicable to your selected plan
• Provide valid payment information and authorize us to charge your payment method
• Pay any applicable taxes associated with your subscription

Subscription fees are charged in advance on a monthly or annual basis, as selected. We reserve the right to change subscription pricing with 30 days' notice. Price changes will take effect at your next renewal date.

If payment fails, we will notify you and provide a grace period to update your payment method. After the grace period, access to paid features may be suspended until payment is received.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Store, transmit, or process data in a way that violates applicable data protection laws
• Attempt to gain unauthorized access to the Service or its infrastructure
• Introduce malware, viruses, or other harmful code
• Use the Service to send spam or unauthorized marketing communications
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Resell or sublicense access to the Service without our written consent
• Use the Service for any purpose other than managing your automotive business

We reserve the right to suspend or terminate accounts that violate these restrictions.

You retain all rights to the data you input into the Service, including customer records, vehicle history, financial data, and other business information ("Your Data").

You grant Mech Connect a limited license to process Your Data solely for the purpose of providing the Service to you. We will not use Your Data for any other purpose, including marketing to your customers or sharing it with third parties, except as required to deliver the Service or as required by law.

You are responsible for ensuring that Your Data complies with applicable laws, including data protection laws. You are responsible for maintaining appropriate backups of Your Data.

Upon account termination, you can export Your Data within 30 days. After 30 days, Your Data may be deleted in accordance with our data retention policy.

The Mech Connect platform, including its software, design, features, and documentation, is and remains the intellectual property of Mech Connect. These Terms do not grant you any ownership rights in the platform.

The Mech Connect name, logo, and trademarks are owned by Mech Connect. You may not use them without our prior written consent.

Feedback or suggestions you provide about the platform may be used by us to improve the Service without any obligation to compensate you.

We aim to provide the Service with high availability, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we aim to notify you in advance)
• Emergency maintenance or security responses
• Events outside our reasonable control (force majeure)

We will make reasonable efforts to restore availability as quickly as possible. We are not liable for losses resulting from temporary unavailability.

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranty of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claims arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you to their full extent.

You may cancel your subscription at any time through your account settings or by contacting us at info@mechconnect.africa. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period, except where required by law.

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees after a grace period, or if we discontinue the Service with reasonable notice.

Upon termination, your access to the platform will cease and your data will be handled in accordance with our Privacy Policy.

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms will be resolved in the courts of Nairobi, Kenya, unless otherwise agreed in writing.

If you are located outside Kenya, you agree to submit to the jurisdiction of Kenyan courts for any dispute arising from these Terms or the Service.

We may update these Terms from time to time. We will notify you of significant changes by email and by displaying a notice within the platform at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
